1. Acceptance of Terms

By accessing or using My Teaching Assistant ("the Service"), operated by AdamZolo LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

Eligibility: You must be at least 18 years old to use the Service.

2. Description of Service

My Teaching Assistant is an AI-powered essay grading tool for teachers and college instructors. It analyzes uploaded student essays against instructor-defined rubrics and provides grading suggestions, scores, and feedback.

3. AI Grades Are Suggestions Only

IMPORTANT DISCLAIMER:

  • Grades and feedback are generated by artificial intelligence and may contain errors
  • AI-generated grades are suggestions — always apply your own professional judgment
  • You are solely responsible for reviewing, adjusting, and issuing final grades
  • We make no guarantee that AI output meets any institutional grading standard

4. Billing and Payment Terms

4.1 Pricing Structure

  • Free Tier: Limited number of essays graded per month at no cost
  • Paid Tiers: Monthly or annual subscriptions with higher essay limits
  • Current pricing is shown on the Pricing page

4.2 Subscription Cancellation

  • Cancel at Period End: You may cancel at any time; access continues until the end of your current billing period
  • No Prorated Refunds: We do not issue refunds for partial months or unused quota

4.3 Price Changes

We reserve the right to modify pricing at any time. Price increases will be announced at least 30 days in advance and apply from the next billing period.

4.4 No Refunds

All payments are final and non-refundable, except as required by applicable law.

5. User Responsibilities

5.1 Account Security

You are responsible for maintaining the confidentiality of your account credentials and all activities that occur under your account.

5.2 Acceptable Use

You agree NOT to:

  • Use the Service for illegal purposes
  • Upload student essays without appropriate authorization or in violation of student privacy laws (e.g., FERPA)
  • Reverse engineer, decompile, or attempt to extract source code
  • Use automated tools to access the Service beyond intended use
  • Upload viruses, malware, or harmful code
  • Share your account credentials with others

5.3 Student Privacy

You are responsible for ensuring your use of the Service complies with applicable student privacy laws (including FERPA and any applicable state laws). We recommend anonymizing student-identifying information in essays before upload where feasible.

5.4 Content Ownership

  • You retain ownership of the essays you upload and the rubrics you create
  • You grant us a limited license to process and store your content solely to provide the Service

6. Intellectual Property

My Teaching Assistant's software, UI, and AI integrations are our proprietary property. You may not copy, modify, or create derivative works of the Service.

7. AI-Generated Content Disclaimer

  • Grading results are AI-generated and may not be accurate or complete
  • The Service may misinterpret essay content or apply rubric criteria incorrectly
  • Always review the original essay alongside the AI feedback before issuing a grade
  • We do not guarantee any specific grading accuracy or outcomes
  • You use the grading suggestions at your own risk and professional discretion

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
  • WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED
  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM
  • WE ARE NOT LIABLE FOR errors in AI grading, grading decisions you make, or issues with third-party services

9. Privacy

Your use of the Service is also governed by our Privacy Policy.

10. Termination

10.1 By You

You may terminate your account at any time by canceling your subscription and stopping use of the Service.

10.2 By Us

We may suspend or terminate your access without notice if you violate these Terms, we suspect fraudulent activity, or for non-payment.

10.3 Effect of Termination

  • Your right to use the Service terminates immediately
  • We may delete your account and content after termination
  • You remain responsible for all charges incurred before termination

11. Dispute Resolution

11.1 Informal Resolution

11.2 Governing Law

These Terms are governed by the laws of the State of Ohio, United States, without regard to conflict of law principles.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the updated Terms.

13. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.
